CONSENT TO ELECTRONIC COMMUNICATIONS AND DISCLOSURES (“ESIGN Consent”)

We (which for the purposes of this ESIGN Consent includes EasyPay Finance, TAB Bank and their respective agents, assigns and service providers) may be required by law to give you certain information “in writing,” or electronically with your informed consent. You agree that, in accordance with the terms set forth below, we may use electronic records and signatures in our relationship with you and give you electronically any credit application, any agreement relating to any resulting extension of credit, any disclosures relating to your application and/or extension of credit and any payment plan or other agreement related to your application and/or extension of credit or to any future applications and/or extensions of credit.

Consent to Receive Electronic Disclosures

We may provide disclosures to you and communicate or otherwise conduct business with you in electronic format as to all “Communications.” “Communications” may include, without limitation, any credit application; any and all notices concerning a credit application or the terms of any credit that may be provided to you; your credit agreement(s) (if you are approved for credit and wish to accept our credit offer); our privacy policy; communications concerning the status and history of any extension(s) of credit; any other agreements between you and us; and any other records, documents and further disclosures required by federal, state or local law or regulation. This includes disclosures given under (1) the federal Equal Credit Opportunity Act and Regulation B; (2) the federal Fair Credit Reporting Act; (3) the federal Truth in Lending Act and Regulation Z; (4) the federal Electronic Funds Transfer Act and Regulation E; (5) the federal Gramm-Leach-Bliley Act; and (6) the federal Telephone Consumer Protection Act. We may always, in our sole discretion, provide you with any Communications on paper, even if you have authorized electronic delivery. Your consent will apply to this transaction and all documents related to this transaction, as well as all future transactions with us.

Your Contact Information

You agree that Communications may be sent to you by email, which may contain attachments in PDF format, or text message and/or they may be made available to you in the consumer online portal section of our website. Because we may provide Communications to you via email or text message and/or notify you by email or text message of Communications available on our website, it is important that we have your current email address and cellular telephone number at all times. If the email address or cellular telephone number provided as part of your credit application changes at any time or ceases to be your preferred email address or cellular telephone number, please contact us at 1-866-438-8372 or via email at:[email protected] to update your email address or cellular telephone number. You may also update your email address or cellular telephone number by logging into your account profile atwww.myeasypayfinance.com. You should make sure that any spam filter you use is set to allow receipt of messages from [email protected].

Hardware and Software Requirements

To access and retain electronic Communications, you will need:

An Internet connection;
Software that is currently being supported by its publisher of Internet Explorer, Edge, Chrome, Safari or Firefox;
A supported program that accurately reads and displays PDF files;
A valid email address which you have provided to us;
A cellular telephone capable of receiving text messages;
A computer or mobile device with an operating system capable of supporting all of the above; and Sufficient storage space to save past Communications or an installed printer to print them.

You acknowledge that you meet the hardware and software requirements above. We reserve the right to discontinue providing access to Communications through any software that, in our sole opinion, suffers from a security flaw or other flaw that makes it unsuitable for use.

We will notify you if there are any material changes to the hardware or software needed to receive electronic Communications from us. Continuing to access your account through the online portal after receiving notice of such a change is reaffirmation of your consent.

Requesting Paper Copies/Withdrawing Consent

If you would like a paper copy of a Communication we previously sent you electronically or if you would like to withdraw your consent to receive electronic Communications, please contact us by emailing[email protected] or calling us at 1-866-438-8372. Include your name, email address and account number in any such request and please indicate that you are withdrawing your consent to receive electronic Communications from us. If you withdraw your consent to receive electronic Communications, you will not be able to do business with us electronically, but the withdrawal will not affect any previously provided or agreed upon Communications. There is no cost to you to receive paper copies of any Communications. We may need to verify your identity before sending paper copies to the physical United States address you provide.
